Hall, Farley has defended several liquor liability cases in Idaho, through trial and appeal. The
firm's attorneys have also presented risk management programs to restaurant and bar owner
associations. Idaho has a Dram Shop Act which limits potential liability of those who serve or sell
alcoholic beverages. Liability potentially exists only in those instances where the seller or server
sold alcohol to a minor who the seller knew or reasonably should have known was under legal
age, or the seller or server knew or should have known the person was obviously intoxicated.
The firm recently was successful in reversing a lower court pre-trial opinion that only a
convenience store should be on the verdict form as a defendant in a Dram Shop case arising
from the tragic wrongful death of a family killed by an intoxicated driver who had purchased beer
from the store less than a half hour before the accident. Idaho Dept. of Labor, et al, v. Sunset
Marts, Inc., 91 P.3rd 1111 (2004). The case is awaiting trial.

Mark Roberts has a great deal of experience in liquor liability cases, authoring two chapters in a
Liquor Liability legal book (Liquor Liability Law, Mosher, Chapters 24-25, Matthew Bender [1987[).
The chapters dealt with discovery in defending liquor liability claims. Mr. Roberts has also spoken

In New Jersey, Colleen Ready, Esq., has handled a wide variety of liquor liability cases. Most
recently, Colleen successfully defended a case involving an assault (with a pool stick) in a bar
(brain injury). The plaintiff alleged that he and the assailant were visibly intoxicated, which led to
the assault. Also quite recently, Colleen defended a bar in a case wherein the operator of a MV
was alleged to have been served alcohol while visibly intoxicated. The plaintiff relied on testimony
of witnesses regarding conduct and the opinion of a toxicologist who interpreted the BAC; Colleen
obtained a “no cause.” Finally, Colleen recently obtained a dismissal in a case on behalf of her
defendant client, Aramark. The plaintiff was seeking damages arising out of an assault at
Veteran's Stadium resulting in a death. Colleen successfully disputed the "culture of intoxication"
theory advanced by plaintiff in reliance on vigorous cross-examination of the fact witnesses.

Mr. Hartzog has represented numerous establishments in liquor law liability cases in both state
and federal courts in North Carolina, from Hickory in the west to Kill Devil Hills in the east. He
has defended cases involving the serving of underage persons and those alleged to be under the
influence of alcohol. These cases have included claims against bars, restaurants, hotels, private
